Terms of Service

1. Service description
The Smart Website Co. (“we”, “us”, “our”) provides website design, build, and hosting services to Australian tradies and small businesses. Our service includes:
- Custom website design and build
- Monthly hosting and maintenance
- Optional add-on services (AI chatbot, AI receptionist, additional pages)
2. Pricing and payment
Our standard pricing is:
- Starter: $497 setup + $147/month hosting
- Growth: $797 setup + $197/month hosting
- Premium: $1,497 setup + $347/month hosting
- Full Stack: $2,497 setup + $497/month hosting
Setup fee is charged upfront before work begins. Monthly hosting is billed on the same date each month via Stripe. Prices are in AUD and include GST.
3. 14-day delivery guarantee
We guarantee your website will be delivered within 14 days of payment. If we miss this deadline due to our fault, we will refund your setup fee in full.
4. Revisions
Your package includes 2 rounds of revisions. A “round” is a single batch of feedback submitted at one time. Additional revision rounds are available at $97 per round.
5. Cancellation
You can cancel your monthly hosting at any time with 30 days notice. To cancel, email hello@thesmartwebsite.co. On cancellation, your website will be taken down at the end of your current billing period. The setup fee is non-refundable once work has commenced.
6. Content and intellectual property
You retain all rights to the content you provide (logos, photos, copy). Upon full payment, you own the final website design. We retain the right to showcase your site in our portfolio unless you request otherwise in writing.
7. Refund policy
If you are not satisfied with your website within 7 days of delivery, you can request a full refund of the setup fee. After 7 days, refunds are at our discretion based on the circumstances.
8. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising from our services is limited to the amount you have paid us in the 12 months preceding the claim.
9. Governing law
These terms are governed by the laws of New South Wales, Australia. Any disputes will be handled in NSW courts.
